Know Your Debt Collection Rights

Abusive debt collectors intentionally employ aggressive and unethical practices meant to take advantage of the vulnerabilities and distress that consumers experience when dealing with overwhelming debt. This stress can make it easy to forget that you have rights intended to protect you from these abusive debt collectors.

The Fair Debt Collection Practices Act (FDCPA) provides consumer protections against harassment and abusive practices from debt collectors. 

The FDCPA prohibits debt collection agencies, debt buyers, and other third-party collectors from a wide range of dishonest and abusive practices, including:

  • Attempting to collect a debt you don't owe

  • Attempting to collect more than you owe on the debt

  • Attempting to intimidate you in any way

  • Calling multiple times each week intending to harass

  • Calling in the early morning or late night

  • Calling at work when they know your employer objects

  • Calling friends, family, or neighbors for purposes other that to find out how to contact you

  • Threatening lawsuits, violence, or arrest

  • Making criminal accusations toward you

  • Misleading you about the legal status of the debt

  • Misrepresenting that they are law enforcement officers, attorneys, or court personnel

  • Using profanity or obscene language

  • Threatening negative credit reporting

  • Contacting you after you have told them, in writing, to stop

  • Using automated robocalls in their attempts to collect

Deby buyers purchase uncollectible debt from creditors like banks, credit card companies, lending companies, and utility companies. Debt buyers purchase the debt from these companies in bulk and end up paying pennies on the dollar for the "junk debt." 

Once the debt buyer has purchased the debt, they become the new owner of the debt and have all the rights of the original owner, including the right to collect on that debt. After the debt has been purchased, the debt will typically show up on the consumer's credit report as a new account with the debt buyer as the new owner of the debt.

Because debt buyers only make money when they collect the debt they've purchased, most debt buyers can be very aggressive in their collection efforts and many of them employ brazen and abusive tactics that violate state and federal consumer protection laws.

 

However, most consumers are not aware of their the laws that have been put in place to protect them against abusive debt collectors. These companies know this so they are not too concerned with getting caught violating these laws. Even when caught, the big companies that can afford it, just pay the fines and continue their abusive practices.
